PLANNING BOARD
                                                                   MEETING MINUTES
                                                                       January 17, 2006

The meeting opened at 7:00 PM with the following members in attendance: Helmut Busack, Chairman; Don Bormes and Dick Gardner, members; Carmine Cioffi and James Cianci, alternates; Andrew Livernois, Selectman Representative and Dave Lorch, Town Planner. Carmine Cioffi is made voting member in place of Ralph Carter who was absent.

Action on Minutes for 11/1, 12/6, 12/20 and 1/3 postponed until later in the meeting, if time allows.

Old Business:
Public Hearing on proposed Zoning changes
Helmut Busack asks the Town Planner Dave Lorch where Notice of Public Hearing was posted. Dave has posted notices at the Post Office, Town Office and the agenda was to be published in The Citizen Newspaper.
Susan Sleeper expressed concern that the public notice in the newspaper may not have been published in a timely manner.
Helmut Busack makes a motion to remove highway commercial  from minimum lot requirements in the Zoning Ordinance. Carmine Cioffi seconds the motion. Vote: 4 for and 1 against. Motion passed.
The Board would like a second public hearing which will be published in the newspaper with adequate description of zoning changes.

Public Hearing on PSNH tree clearing on Perkins Rd.
David R. Crane an Arborist with PSNH explains that this is normal routine maintenance performed in 5 year intervals. The clearing will take place on the Eastern end of Perkins Rd. PSNH will contact the abutters to the areas being cleared.
Linda Salitiello inquired as to whether the Conservation Commission was notified. Mr. Crane was not aware that they should be. Dave Lorch will send notice to the Conservation Commission.

Subdivision application PO4-SO7 to create 17 new residential lots.
Applicant has requested a Continuance to Feb. 21. Waiting on appeal to ZBA.

New Business:
Subdivision application PO6-SO1 Chieko Vilas owner, Hermit Woods Road, map 8 lot 86 to create one new building lot.
The applicant requested a varience from the ZBA. The Varience requested allows for less than the required road frontage for a building lot. The Varience was granted, but the 30 day right to appeal has not been met yet.
Dick Gardner makes a motion to accept the application as complete. Carmine Cioffi seconds the motion. Vote: Unanimous. Motion passed.
Bryan Bailey presents for Mrs. Vilas. This is a large lot with a small amount of rd. frontage on Hermit Woods Rd. There are 2 houses at this time on one lot. There is one house adjacent to the rd. with a portion of the house located within the front setback. The lot is nonconforming in that a portion of one house is in the front setback and there is a second house on the property. The purpose of the subdivsion would be to seperate the land around the homes and make them legal lots. Linda Salitiello asks what the frontage for the new lot is. It is the 175' as required. Mrs. Salitiello also wants to know if the lot can be further subdivided. Mr. Bailey says the liklihood is slim unless a new rd. is put in and  all the town requirements are met. Helmut Busack asks to have wells on the existing residences shown on the map. Gary Westergren an abutter to the property has filed a motion to rehear on the ZBA Approval. Mr. Westergren is also concerned about further subdivision to the property. He is requesting that the ZBA attach a condition of no further subdivision of this parcel, and asking the Planning Board to do the same. Helmut Busack suggests that the application should be continued until after the ZBA rehears the application. Tom Salitiello states that he feels that it would be reasonable to attach a condition of no further subdivision, but he also agrees with Mrs. Vilas's plan for the subdivision. Andrew Livernois makes a motion to continue this application to Feb. 21. Don Bormes seconds the motion. Vote: Unanimous. Motion passed.

Correspondence:
Letter from Gerard and Susan Gagne and related minutes from Selectmans meeting. Broadview Drive.
The Board agrees that this is not an issue for the Planning Board. The Gagnes need to address the BOS.

New Alternate Board Member:
Erica Schrader has expressed an interest in becoming an alternate member of the board. She feels that she would be bringing a fresh objective point of view to the table. The Board is in favor of bringing Erica on board. They are happy to see that the youth in our community are expressing an interest in town business.

Dick Gardner makes a motion to adjourn the Planning Board Meeting at 8:15 PM. Andrew Livernois seconds the motion. Vote: Unanimous. Motion passed.

Non Public Meeting at 8:15 PM- Board meets with Town Counsel.
