Draft Planning Board Minutes
August 17, 2006
The meeting opened at 7:02 pm with following members in attendance: Helmut Busack, Chairman; Don Bormes, Vice Chair; Ralph Carter and Dick Gardner, members; Bob Ward, Planner and Selectmen’s Representative Andrew Livernois arrived at 7:10 pm.

        As listed above.  Absent were alternates, Ernie Martel, Cindy Merchant and Carmine Cioffi.

3. Action on Minutes
        Chairman Busack postponed the action on the Minutes of August 3, 2006, to move forward on tonight’s applications

5. New Business
        Public hearing on Bingham Family Trust / 4-lot subdivision on NH Route 132 # P06-S10
                Bob Ward presented the application to the board noting that is complete and all information required has been turned in. Information that has been provided since the last meeting on this matter was discussed and reviewed with the board.  Ralph Carter made a motion to accept the application for  P06-S10 as completed, 2nd by Don Bormes.  Vote was unanimous, application accepted.
                Mr. Frank Yurkees presented the Bingham Family Trust plans to the board, stating that the title be revised to David Bingham Trust, for the record. Mr. Yurkees stated that they are proposing a 4-lot subdivision located on RT 132, on 1069 acres.  A current boundary survey has been completed, proposing the lots marked 1-4, all will be accessed through RT 132. The jurisdictional wetlands have all been delineated by a wetlands scientist. (with 75 foot set back included as part of our ordinance as well as the 100-foot set back for the septic systems) Mr. Yurkees reports that they have applied for and received 3 driveways permits from DOT, allowing lot 1 & 2 to have their own driveways and lot 3 & 4 will share a common driveway. (with a common access easement) Permit for these driveways were issued on  June 22, 2006.  
                Mr. Byron Bedard, abutter from 618 Sanborn Road, spoke in support of the plan and sub division, however Mr. Bedard shared his concern regarding water run off these lots and the affect it may have on his location.  Mr. Bedard discussed the recent storms and water problems he has faced and potential problems that could be added to this situation upon development of these lots in the future. The board discussed with Mr. Bedard and Mr. Yurkees possible suggestions that could be put in as conditions for when this subdivision gets to the building permit stage,  concerning an erosion & sediment control plan to show how the control of run off will be handled.  Other issues discussed with respect to this subdivision were, test pit data, DES permit issued 8/15/06, fed ex attempts to reach abutter, the road frontage of each of the 4 lots and requirements that the Historical District requires, all of which have been met for this applicant.
                Ralph Carter and Bob Ward recommended that Mr. Yurkees and Mr. Bedard make contact with District 3 Office and the Belknap County Conservation  office to entertain an engineer’s assessment of the water run off situation discussed tonight.  Mr. Yurkees agreed to make these contacts and report next month.  Ralph Carter made a motion to continue the Bingham Trust hearing next month at the September 21, 2006 meeting, 2nd by Dick Gardner, all in favor.  
                Bob Ward addressed the process that was followed with this application and questioned the pre-application process included in the statues.  Mr. Yurkees responded that he felt that it was not necessary to have a pre-application meeting in this matter, he felt all the ordinances and requirements were being met.  Bob feels consideration be given to the pre-application process where at that time details of the subdivision can be worked out then. Bob Ward feels that a review of the boards process needs to be tightened up and the regulations and their provisions need fine-tuning.  Bob also suggests that the regulations  need to fit with zoning ordinances as well.

3. Minutes
        Ralph Carter made a motion to accept the minutes of August 3, 2006, with one change to 4a. change ZBA to Zoning , 2nd by Don Bormes, Dick Gardner-abstains-he was absent, all were in favor, minutes accepted.

6. Other Business
        Bob Ward reported that the Richard & Cynthia Pitinski signed and it is ready for September regular meeting.
        a. Albert & Donna Ducharme /9-lot subdivision in Meredith NH (Dev of Reg Imp)
                Bob Ward reported that he spoke with the Meredith town Planner, and that at least two people from Sanbornton attended the site walk on Sat. August  12, 2006. Public hearing is continued until next Tuesday.  Bob has reviewed the records and has comments that were made in 3 meetings that were previously submitted. Bob states for the record, this subdivision was originally submitted as a 14-lot subdivision and later withdrawn.  At that time the board had comments in their meeting of September 20, 2005, when Donna Ducharme was here to present and that the Conservation Commission of the Town of Sanbornton had no concerns , and the only concern of the Planning Board was the traffic impact and that Ms. Ducharme will give a copy of the traffic report to the town planner when they receive it. On November 15, 2005, the Ducharme’s subdivision came before the board again and the minutes indicate that the town of Meredith is inviting comment from the Sanbornton Planning board who discussed  upgrading  New Road and Oak Hill Road and that Chair Busack states the planning board and the department of public works oversee the upgrades and a motion by Ralph Carter to require New Road and Oak Hill Road to be widened  to 22 feet with gravel surface and drainage, 2nd by Don Bormes and vote was passed unimously. On November 17, 2005, the town planner sent a memo to Meredith stating the motion and the vote.  On December 20, 2005 at the continued review, town planner overviewed the plans for the subdivision  and Chair Busack expressed concerns that the planning board wrote to the Board of Selectman and did not get a response, but Selectman Giunta stated that Selectman Livernois is working with the Meredith Planning Board and will report back.  Also, the Ducharme’s were present and expressed concerns about the process that Sanbornton is following and the letter’s that have been written about the roads, specifically the traffic study that came back as a non-issue and current notations about road upgrades being the responsibility of the applicant and the questions asked of the Ducharme’s probable home business and Ms. Ducharme also questioned the board as to the long list of requests from Sanbornton when the building will be primarily in Meredith. Now the subdivision is a 9-lot conventional subdivision.  
        Ralph Carter gave a review of the site walk on 8/12/06 and stated that on New Road they will be building a road up to the height of land of the cul-de-sac. There will be about 5 houses on that road. This property will access through Roxbury Road, which is the only access for the 104 acre parcel, and Ralph questions how many more lots can be added to that road as he states that where the Class 5 and Class 6 road status starts and stops.  Ralph questions how many more lots can be developed  at this section of the road for this 104-acre parcel and also the question of having a subdivision on a Class 6 road in Sanbornton. Bob states that he believes that there is case law and state law regarding the issuance of building permits on Class 6 roads.  Ralph is concerned with future development of the 104-acre parcel being subdivided into smaller lots in the future and all the traffic that will be traveling through Sanbornton.  Mr. Ward was asked to draft a request that Meredith upgrade their roads so that there is access through Meredith for emergency services and not increase the traffic flow in Sanbornton.

                Bob Ward will contact the McNamara’s to clarify why the plans were sent to the Town of Sanbornton.
7. Planner’s Update
        a. Correspondence- none to report
        b. Discussion re Secretary/Clerk position- Job ad is in newspaper this week, no applicants to date.
        c. Discussion re amendments to Zoning Ordinance- Bob has been doing research and reviewed the copy on file and will hope to have an updated copy at the next workshop.
        d. Discussion re Subdivision Regulations- Bob discussed that when he has a draft ready, he will review it with the board.  In addition, that it will require two public hearings prior to a town vote.
        e. Discussion re Master Plan Update- Bob stated that invites will be sent to the Board of Selectmen, Cemetery Trustees, Conservation Commission, Transfer Station, Recreation, ZBA and Historical District Commission, the only date that seems to work is September 19th from 7-9 pm.  Sanbornton School is available on that night. Bob also will advertise to the public, but the boards and commissions will be the primary source of conversation, hosted by the Planning Board.  Public is invited to listen in without major input if any for this meeting.  Ralph suggests that the first hour be dedicated to the Land Use meeting.

Ralph Carter made a motion to adjourn at 9:42 pm, 2nd by Andrew Livernois all were in favor.
