Draft Planning Board Meeting Minutes
June 6,2006
The meeting opened at 7: 10 p..m.. with the following members in attendance: Helmut Busack, Chairman; Dick Gardner, and Don Bormes, Vice-Chair; Alternates, Cindy Merchant, Carmine Cioffi, and Ernie Martel. Andr.ew Livernois was not present as the Selectmen's Representative. Cindy Merchant replaced Ralph Carter, who was absent, as a voting member.
Sub-division review of Lower Bay Rd - The Board members, Doreen Leavey and BarbaraWhittaker informally reviewed the possIble sub-division of the property located at 31 Lower Bay Road. Ms. Whittaker inquired if the property could be divided in half. Upon review of the property, Chairman Busack stated the single, residential property has the proper road frontage but not the proper amount of acreage to divide the pro~fty. Mr. Gardner
noted the intent of the
ordinance is to not allow for the shorefront to become crowded, which makes Sanbornton's shorefront more valuable. Ms. Leavey and Ms. Whittaker thanked the Board for their time.
Resignation of Town Planner - Chairman Busack announced that the Town Planner has officially resigried as of last Friday and has left on good tenns. Chairman Busack noted Planning Board members assisted Mr. Lorch with his departure for security purposes. The Board agreed not having a Town Planner will delay their work process.
TML # 023.034.000- Chairman Busack explained Nel Bennett owns a piece of land that is located in Tilton, as well as Sanbohiton and has applied for a sub-division with the town of Tilton. The Planning Board will place review of this matter on hold until the Town Planner position is filled.
Vacant Position of Town Planner -Chairnlan Busack informed the Board that T A Kneuer has been asked to advertise to fill the vacancy. Chairman Busack noted the position will pay $18.00- $20.00 dol1ars an hour for a maximum of twenty hours a week. The Board discussed possible candidates for the position. The Planning Board will ask Robert Ward to interview on June 15, 2006 at 7:00 p.m.
May Hearing date RE: Lepene Case - Chairman Busack noted the May hearing has been postponed until June 21st.
Premature for Development - Chairman Busack provided Board members with a document dated 1/13/2003 regarding the Tardiff sub~division application, written by Katie Surowiec the former Town Planner. The Board will review then discuss at a later date.
Report on the work of the Zoning Board- Mr. Bormes stated he will provide the planning board with an update on the work of the ZBA at every Board meting.
Lepene Land Holdings LLC v. Town of Sanbornton -Chairman Busack stated Attorney Waugh submitted a motion to amend, a motion to view and add transcript for the Lepene court case, which has been accepted by the court. Chairman Busack noted the revised motions submitted by Attorney Waugh, should have been reviewed by the Planning Board but were never presented by the Town Planner.
Peter Thompson v. Town of Sanbornton -The Board reviewed the Belknap County Superior court hearing schedule dated 4/6/2006. A hearing on the merits is scheduled fbr 8/9/2006. Mr.Bormes motioned to decide on Attorny Waugh as representation for the Thompson Court case. Mr. Gardner seconded the motion. Discussion; Mr. Gardner motioned to amend the motion, to retain Attorney Waugh1 as long as service is accepted by 6/13 and failing which, the Planning Board use Attorney Boldt. Mr. Bormes seconded the motion. Most of
the Planning Board members felt that Chairman Busack implied he wanted to use Attorney Waugh as representation. Chairman Busack apologized for the misunderstanding and feels any attorney could be retained, not just Attorney Waugh or Attorney Boldt. Mr. Bormes withdrew his motion and Mr. Gardner rescinded his amendment. The Board reviewed the motion of the meeting minutes dated 5/2/2006. Chairman Busack will attend the BOS meeting tornorrow to reiterate the memo sent to the BOS from the Town Planner dated 5/3/2006.
Adjournment- Chairman Busack motioned to adjourn at 8:59 pm., Mrs. Merchant seconded the motion and the motion passed unanimously.
